Preamble

The online sales website whatifparis.com is managed by the company What if Paris, headquartered in Paris, France, registered in the commercial registry under number RCS 876 696 376. These terms and conditions govern the sales of our products to any natural or legal person making a purchase via the website, hereinafter referred to as "the Client".

These General Terms and Conditions of Sale, the order form, and the order confirmation constitute the sales contract between What if Paris and the Client for the sale of the ordered products. Any order placed on the website implies that the Client fully and unconditionally accepts these General Terms and Conditions of Sale.

If the Client disagrees with the terms and conditions, they should not use the website.What if Paris reserves the right to adapt or modify these Terms and Conditions at any time and without notice. In case of modification, the applicable Terms and Conditions for the Client’s order will be those in effect at the time the order was placed.

Definitions

The terms defined by capital letters in these Terms and Conditions shall have the following meanings (whether used in singular or plural):

  • "General Terms and Conditions of Sale": This document, i.e., the terms and conditions that apply in the relationship between What if Paris and the Client.
  • "Order": The Client’s purchase order for one or more Product(s) or Service(s) placed via the Website.
  • "Website": The internet site accessible at whatifparis.com.
  • "Product": A product or service offered for sale on the Website.
  • "Client": A natural or legal person, consumer, who uses the Website and acquires one or more Product(s), for personal needs, having previously agreed to these Terms and Conditions.

Purpose

These General Terms and Conditions of Sale are intended to define the contractual relationships between What if Paris and the Client and the conditions applicable to any purchase made through the website. By accepting these Terms, you declare that you have reached the age of majority in your country, state, or province of residence, and that you have given your consent to allow any minor dependents to purchase on this online sales site.

The use of our products for any illegal or unauthorized purpose is prohibited. What if Paris retains the possibility to modify these Terms at any time, to comply with new regulations or to improve the site's usability. Therefore, the conditions applicable will be those in effect on the date of the Client’s order.

Pricing

Prices listed on whatifparis.com are in Euros (€), including all taxes considering the VAT applicable on the order date. Any change in the VAT rate may be reflected in the product prices. What if Paris reserves the right to change prices at any time, provided that the price listed in the catalog on the order date will be the only one applicable to the Client.

Products remain the property of the website until full payment is received by whatifparis.com. Promotional products will be indicated by an "Last Chance" sticker or a crossed-out price, with promotions valid while stocks last at the time of the order.

For Clients outside Metropolitan France, whatifparis.com is obliged to charge VAT on orders shipped to most European Union countries. For Clients outside the European Union and overseas territories, orders are not subject to VAT but may be subject to local taxes and customs duties in the country of receipt. These duties and sums are not the responsibility of whatifparis.com. They are to be paid by the Client.

Please note that any inaccurate information provided by the Client to evade VAT may result in civil fines and criminal prosecution.

The prices of the Products on the website include processing costs, which will not be charged in addition to the price of the Products purchased. Additional fees such as shipping costs may apply depending on the total amount of the order.

Order

Contractual information is presented in English and will be confirmed with a summary of this information at the latest upon delivery. What if Paris reserves the right to cancel or refuse any order from a client with whom there is a dispute regarding the payment of a previous order.

To order Products on the website, the Client must create an account by providing the required information in the registration form. The Client declares that the personal information provided is complete, accurate, and sufficient for precise identification in any situation. Any fanciful or slanderous personal information may lead to the closure of the Client's account and the cancellation of their Order.

The account creation section is accessible directly from the main menu bar. Each time the Client wishes to order or consult their account (order status, personal information...), they must identify themselves with this information.

Payment

The price of the Products and the logistics preparation and delivery fees are payable in full by the Client at the time of placing the Order. The website may offer the Client various payment options of their choice:

  • By credit card: After choosing credit card payment, the Client is redirected to the secure payment system interface to safely enter their personal credit card references. If the payment is accepted, the order is recorded, and the contract is definitively formed. Credit card payment is irrevocable.
  • By PayPal: After choosing the PayPal payment method, the Client is redirected to the secure payment system interface to safely enter their personal PayPal account references. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by PayPal is irrevocable.

Delivery

Once your order's payment has been confirmed, we will dispatch your products to the delivery address you specified during the checkout process. Depending on the type of product you order, you may be offered different delivery options to choose from.

We meticulously package each item in durable materials, guaranteeing its safe and secure delivery to your doorstep. We prioritize the safe arrival of your artwork, which is why we use sturdy packaging for each item.

For orders with multiple products, they may arrive in separate packages due to our collaboration with various local print partners. This approach helps us avoid delays and ensures efficient printing and delivery based on your location. If an order requires printing at different facilities, we'll split it into multiple shipments for the fastest possible delivery.

For all countries, our standard delivery timeframe is typically between 4 to 8 business days. It's important to note that this is an estimated delivery period, and actual delivery times may vary.

Orders placed from Monday to Friday are processed on the same day, ensuring that your items are meticulously prepared, packaged, and dispatched promptly. You will receive an email notification with tracking details so you can follow the journey of your order.

While we strive to meet these delivery estimates, please be aware that shipping times are indicative. If delivery is delayed beyond 30 days from the time of your order, you have the option to cancel the sales contract and receive a full refund.

We are pleased to offer free delivery on all orders.

Refund & Return Policy

At What if Paris, each art print is printed on demand, reflecting your unique choices and specifications. Due to the custom nature of our artwork, we do not accept returns or exchanges for products unless they arrive damaged or defective.

In the event that you receive a damaged or defective item, we offer a free replacement matching your original order or a refund to your payment method within 15 business days after confirming the issue. 

It's essential for a smooth and efficient resolution that you reach out to us within a 14-day window from receipt of your order, providing clear photographic evidence of any damage or defect. Please visit our shipping & returns policy for more information.

We begin processing orders immediately to ensure prompt delivery. You may request an order cancellation within an hour of purchase if your order has not yet been printed. After this period, we cannot guarantee cancellations as your order may already be in production.

Liability

What if Paris has only an obligation of means for all stages of site access, order process, delivery, customer service, or subsequent services. What if Paris cannot be held responsible for any inconveniences or damages inherent in the use of the internet network, such as data loss, intrusion, virus, service disruption, or other involuntary problems, or any event deemed a force majeure, in accordance with case law.

Computerized records kept in What if Paris's information systems under reasonable security conditions will be considered proof of communications, orders, and payments between What if Paris and the Client.

Security

The website has implemented a security system: the SSL encryption process has been adopted, and the overall scrambling and encryption processes have been strengthened to protect all sensitive data related to payment methods as effectively as possible.

Intellectual Property

All texts, comments, works, illustrations, and images reproduced on the website are reserved under copyright and intellectual property for the entire world. As such, and in accordance with the provisions of the intellectual property code, only private use is authorized, subject to different or more restrictive provisions of the intellectual property code. Any total or partial reproduction of the website is strictly prohibited, whether in the form of photos, logos, visuals, or text.

Personal Data 

All the data you provide on the website are to process your orders. In accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and freedoms, you have the right to rectify, consult, modify, and delete the data you have communicated to us. This right can also be exercised online.

Force Majeure

The performance by What if Parisof all or part of its obligations, in particular delivery, will be suspended in the event of a fortuitous occurrence or a force majeure event that would hinder or delay its execution. Such events include, but are not limited to, war, riots, insurrection, social unrest, strikes of all kinds. What if Paris will inform clients of the occurrence of a fortuitous event or force majeure within seven days of its occurrence. If this suspension continues beyond a period of fifteen days, the Client will have the option to cancel the current order, and a refund for the ordered Products and paid delivery fees will be made.

Applicable Laws and Competent Jurisdictions

The General Terms and Conditions of Sale are subject to French law. In the event of difficulty arising in connection with the Order, delivery of Products, or more generally the execution of the sale, the Client has the possibility, before any legal action, to seek an amicable solution, especially with the help of a consumer association or any other advice of their choice.
